Legal Question in Family Law in Florida

About my boyfriend

He is legally married to another woman, but we have been 20 yrs together and have raised our children together, which they are all now adults. My question is? Can we legally marry without him have to go through divorce expenses. Furthermore, he does not know her whereabouts.

Hi:

My initial gut response is do not fix it if it is not broken. Technically since he is not legally divorced from his first wife, irrespective of your history together, your marriage to him would not be legal, should the twenty years gone ex wife reappear.

What you should do is speak with an attorney who will file the papers and make the court appearance, etc to get your boyfriend divorced, if you both want to marry. Chances you will try to have her served at her last known address and then will probably have to ask the court to serve her by publication.

If you both feel that you can handle this yourself, the bar assocation has self help forms that you can fill out yourself.
