Legal Question in Family Law in Florida

My boyfriend and I currently Live together. His 9 year old son lives with us and goes to school under our address.. His ex wife and him have a 50/50 custody agreement... however everytime she has him he is either late or he misses school.... even the teachers have noticed a trend. I was wondering how much we are looking to spend to take her to court and change the dates she has him... she currently has him Thursday-Tuesday of everyother week???

To do a modification of the Parenting Plan/time-sharing, you would have court costs of $100.00 plus attorney fees in the $1,500.00 to $2,500.00 range.

You should consult with an attorney in your area to weigh all of your options.

What you are looking to do is called a "Supplemental Modification," and, in your case, it's a modification of the timesharing plan. The court fee is $50 (not $100 as the other lawyer has suggested), there will be a mediation fee of usually either $60 or $120 depending on the parties' income for courthouse mediation in Tampa (the area which your zip code indicates). Subpoenas and expert witness fees could cost more, and attorney fees are very tough to judge, since it will depend on how much the mother fights. I would think, at a minimum, attorney fees will be about $2,000, and they could run several thousand dollars.
