Legal Question in Family Law in Florida

My boyfriend & I have lived together for 5 years in Florida. The apartment lease is in my name only. Recently, he has become violent. I want him out. Please advise as to how to do this.

In response to your question:

1. Write in a letter advising that you are demanding he move out within 5days. Tell him Florida law states you are the tenant, not him and if he doesn't leave you'll file an eviction. Further, pursuant to Fla. law if you win with the eviction, he will have to reimburse you for the filing fee, service of papers and atty fees if any.

2. You could file for an injunction for protection against domestic violence. If your allegations meet the legal requirements, a temporary injunction will be granted immediately with a hearing date in about 15 days for the court to determine if the inj. will be extended for a longer period of time or permanently.
