Legal Question in Family Law in Florida

My boyfriend got married in the state of Florida in 1992; separated in 1994, no papers were ever drawn. His wife went to Georgia and married a man 1996. Now that we have been dating for 7 months, I wont even discuss the future until he straightens out this past. Does he have to get a divorce? I would think they would still be legally married. How do we go about this and where do we start?

If they've only "separated" and never legally divorced then he does need to file a Petition for Dissolution of Marriage . His wife is married illegally as she is married twice. If he wants to file a Dissolution of Marriage action, he would need to prepare the paperwork for filing. There are several items that he would need to put together, which if you are trying to do this paperwork on your own is available for free at flcourts.org. If I can be of further assistance, do not hesitate to reach me directly.
