My boyfriends son

My boyfriends son is 13 and his mom has custody, he wants to live with his dad, but his mom refuses. At what age can a child make that decision?

The child's choice is one of many factors the court will consider in making their decision. But the child's choice alone will not be a determining factor. If your boyfriend wants custody he would have to petition the court.
