Legal Question in Family Law in Florida

my brother and sisterlaw are battling it out with DCF,CPS, my 6month old nephew is with a foster guardian at this time, my question is until proven guilty dont my brother and wife have parental rights to medical records hospital records and so on. Also we finally got a hold of hospital records for yesterday and the foster guardian put down herself for next of kin. isnt this illegal? Also there are no crimal charges pending they both past there lie detector tests, cps has NOT filed a petition as of yet and trial is set for Jan 6th 2011 isnt this grounds for dismissal of the entire case?

No. A hearing has been set and until that time the guardian is the next of kin to contact.
