Legal Question in Family Law in Florida

Broward county -divorce

I am currently incarcerated, divorced while serving time, about to be released and want to settle thing left pending in my divorce case. Divorce was granted but issues regarding my wife's pension, the sale of our business, etc. are still open. I would like to get the ball moving now, so upon my release all will be settled. Due to the circumstance, I need an attorney would will subtract his fees from the monies I have coming as the outcome of the settlement.

Without reading your file, no one can advise you properly. Should you have a valid claim, I am sure a contingency agreement can be worked out.

Once the divorce is over, it's over, and things not settled during the divorce are no longer considered part of the divorce (except as to issies regarding children). However, you may still be able to settle the issues in civil court as if the two of you were business partners, not husband and wife. You'll need a civil lawyer, not a divorce lawyer, for that. Things are treated much differently in civil court than in divorce court. For instance, you've likely lost your rights to her pension, but you could sit down with a local divorce lawyer to be sure. The one exception is if she hid things from you during the marriage and during the divorce proceedings.
