buying my sisters truck for pay off

my sister and her husband are currently seperated. she has a truck she bought while they were married. it is titled under her name only. can i buy the truck from her for the balance owed. they have not filed for a divorce at this piont. his name is not on any paper work. if i buy it before they file for divorce, is he entitled to any compesation

As far as the State is concerned, since the title is only in her name, she can sell it to you. As far as the family law judge is concerned, it is marital property and her husband is technically entitled to half of the proceeds/value. What usually ends up happening is that she will give up something else in the settlement talks (something like furniture, the computer, the big screen TV, or a certain amount of money from the sale of the home, from a bank account, etc.)
