Legal Question in Family Law in Florida

Calculating Child Support Using FL Guidelines

Need to understand how child support is calculated in FL using the guidelines. Parents not married and have 1 child together. CP has the 1 child and has filed for child support order. NCP has 2 other kids that are not a party to the suit, one just turned 18. How many kids are figured into the calculations?

Re: Calculating Child Support Using FL Guidelines

No other children are figured into the calculation unless court-ordered child support is paid on one or more of the other children, in which case the judge may apply what's called the "Smith rule." You'll have to speak with a Family Lawyer about the Smith rule if it applies to your support, since it's applied differently in different parts of the state. In some parts of the state, they don't even use the Smith rule, so child support is figured on income alone, without regard to other support paid.
