Cancelled child support

My ex husband that is in prision informed me that he was going to have the child support erased since he's been in there and stoped until he gets released I want to know if he can do that? if so what can I do to stop it?

Re: Canceled child support

Probably. Child support is based on the income of the parties. If the Husband is incarcerated and has no income, then the Court may relieve him from responsibility to pay child support.

Remember, only the Court can relieve the Husband of his responsibilty to pay child support. There is not automatic relief as a result of his incarceration. This is a serious legal matter and you should consult an experienced family lawyer to review your problem.
