Car ownership

In 2006 we bought a new car for me,

and it is in my name. However, my

husband makes all of the checks out

from our joint checking account for

the monthly car payment, and has

told me he wants to be the one to do

that. If he decides this marriage

should end, who would get the car?

It is not paid off and my income

alone may not be enough to make

those payments, if he does leave, I

doubt there will be extra money

provided for me.

The best thing would be for the car to be refinanced into his name, since you can't afford it. If it can't be refinanced, he'd probably keep the car and the payment, and your settlement agreement would have to ensure that he keeps plenty of insurance on the car, since having your name on the car makes you liable if the car is in an accident and it's not the other driver's fault.
