Legal Question in Family Law in Florida

Cell Phone Harrassment

My have a 9yr old son. I was never married to his father. We are no longer together, as I live in Florida and he lives in NY. He calls me CONSTANTLY! Some days he calls me 8 times in a two hour span! One day he left me 16 voice mail messages.I have told him that the calls are disruptive to my daily life but he still continues to harrass me. What can I do about this? Are there any laws against this?

NOTE: This communication is not intended as and should not be interpreted as legal advice. Rather, it is intended solely as a general discussion of legal principles. You should not rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorney's individualized advice for you. By reading the "Response" to your question or comment, you agree that the opinion expressed is not intended to, nor does it, create any attorney-client relationship, nor does it constitute legal advice to any person reviewing such information, nor will it be considered an attorney-client privileged communication. If you do not agree, then stop right here, and do not read any further.

If it is truly disruptive and abusive, you can go to court and ask for a restraining order which would prohibit him from making so many calls. Please understand that the father has EQUAL rights to the parenting of his son. It is unlikely that a court would bar all contact with his son.

A simplier method might be for you to request the father to provide the son with a cell phone so that he and dad can communicate freely. Dad will have to understand that cell phones are not allowed during school hours and study times at home.
