Legal Question in Family Law in Florida

change in child visitation

For the past couple of years I have been letting my husband have my son for the summer and on some vacations due to the fact that I believe he should see him. Well, he is filing to have him all summer and not have to pay child support during that time, and to have him every other holiday, and to get to file his income tax claiming him every other year. In the original agreement, he is not allowed to have him overnight, and to let me claim him on taxes. His child support has just been raised, and I think this is why he's taking me to court. Can he get this? I have been trying to be civil and let the child have visitation. Am I in contempt of court?

Re: change in child visitation

You are not in contempt of anything if you are complying with court orders. If you oppose his

request for good reasons you may contest the matter. You should look into retaining an attorney. Good luck.
