Change in custody

My 16 year old son would like to stay with me than with his father.Is he able to make this decision at his age?

No. He is not an adult, so he doesn't get to call the shots. You and his father get to call the shots. If the two of you agree, he can certainly live with you. However, it would be a very good idea to have the court order changed so that you assume primary residential responsibility. Please feel free to contact my office if I can assist you.
