Name Change of Minor with Sole Custody

Please help with the following scenario:

Would like to change last name of minor child

to my last name. Child was born in Texas.

Both parents now reside in FL. Parents never

married. Mother(myself) fought and received

sole custody last yr. Father has paid no child

support since separation in 2001. He sees her

for only 6 wks in summer and either her b-day or

christmas according to our custody agreement. Every

other weekends are available, but he doesn't use it.

What is the likely hood I could fight to change

her last name to mine and win? Do I need his

permission even though I have sole custody? I know

that he would try to fight it, so what am I looking

at in legal fees? Is there just a flat rate?

1. you will need a court order.
