name change for minor

I have a 5 year old son. My son's last name is different. His last name is my girlfriends husband last name. The kid lives with me and my girlfriend but she is still married to her husband. I would like to change it to my last name but do not know the steps to take. My girlfriend refuse to leave her husband for complicated reason. the husband is not at all involved with the kid. Please advise Thank You

Unless the husband agrees, you cannot change the name.

If the parents of the child consent (this seems to not be a problem in your case), you can change the name by filing a Petition to Change Name in the local circuit court. You can explain why a different name is on the birth certificate, I assume. It appears that your son should have your last name, and now is the time to do it, i.e., before he starts school. Contact a local attorney or get a form from an internet site for Florida law forms. It is simple and doesn't cost much except for a filing fee and attorney fee, if you employ an attorney.
