Name Change
I requested in my counterpetition that my name be restored to my maiden name. My husband's attorney stated that I wished it to be restored in the stipulation and agreement. He also sent along an affidavit that looks alot like the affidavit to be used in cases unconnected with a divorce and I understood that such an affidavit wasn't to be used, that the counterpetition and agreement should take care of it. Who's right??

You did the correct thing which was file a counter-petition and request your maiden name. Just be sure that your request is stated in the Final Judgment for Dissolution of Marriage and be sure to attend the final hearing to tell the Judge that you want your maiden name. I do not know what document this attorney is requesting that you sign and can not comment without reviewing it first.
