Legal Question in Family Law in Florida
How to change support order to another state
We moved from Florida 2 yrs ago,the ex still lives there, and that is where the order was initiated and still remains open.My husband was transferred to Wisconsin thru the same company so support was taken directly out of his check. Now,he has quit his job and we are starting our own business. My question is, how do we change the order to go thru Wisconsin where the guidelines are more lenient. We want to settle this before he receives his last check and falls behind. He currently pays $900/month for 2 kids, which is 45% of his income.Despite modification appeals it has never been lowered.Plus he NEVER sees his kids. I would also like to know if it is possible for him to terminate his rights alltogether without the mothers consent. At the very minimum we need to change the case to go by Wisconsin guidelines. Please let me know I can go about doing this. I thought the guidelines were set by where the father resides. Please help!

Re: How to change support order to another state
You have asked a very difficult question which encompasses analysis of the Uniform Child Custody Jurisdiction Act, as well as the Uniform Interstate Family Support Act (Chapter 769 Wis. Stats). A clear cut answer cannot be given based upon the limited information and I would suggest that you schedule an appointment with an attorney and bring appropriate documentation to support the facts that you have set forth in your e-mail.
This is not legal advice. This is an answer to a general question without all the facts being present. Please contact me at (262) 642-4368 to discuss this further. Victoria A. Oleniczak

You must seek modification in Florida.
