Legal Question in Family Law in Florida
Change of Venue & Contempt Charges
My husband & his ex wife were divorced in Collier County Florida. We are presently living with both his children in Palm Beach County. His ex is presently living in N. Carolina while her new husband is in jail. Before moving to NC she was living in Martin County Florida. Since there divorce was done in Collier that is where the case is. How can we change venuw to Palm Beach County? She also has a contempt charge against him for unpaid child support but he has records that he paid her and is not deliquent. How do we get the charges dismissed/dropped and have the court record show that he is not deliquent but current?

retain counsel to seek a change of venue.
Re: Change of Venue & Contempt Charges
Check the Judgment of Divorce and/or matrimonial settlement to see if there are any provisions regarding returning to Court. You may have to request mediation before you can return to Court.
Also check to see if jurisdiction was retained by the Court that issue the Judgment.
Once clear, you may have to retain counsel to transfer venue of the issues to the county you now reside.
