Legal Question in Family Law in Florida
When can I change venue?
My divorce is taking place in IL. I just want to get it over with. How soon can I change it down to Florida to where my son and I have been living for the past 2 years?

Re: When can I change venue?
Hello. First, do you want the divorce to be held in Il? I ask because since the child has been here for two years (6 mos. satisfies our Statute) I believe jurisdiction could be here.
If you want it moved, you will need to immediately file a motion to dismiss or whatever is applicable under the law up there with the court up there.
If you want it left there or a court has ruled for it to be up there, you can file later motions to enforce provisions or requests for modifications here. There are some hoops to jump through first. Basically, you would need a certified copy of the Final ruling from the Clerk of Court up there. You would need to file that with the Clerk in the county where you reside. There may be a couple of other technical requirements I simply want to give an overview here. 'Hope this helps. Tom Rosenblum
