changing a childs last name

I gave my child her fathers last name at birth but I was never married to this person. I am now married to someone else and want to change her last name to my last name now.

Do I need an attorney to do this and how difficult is this.

It depends on whether the child's biological father (if his consent is necessary) would contest the name change. He would likley (if his location is known or discoverable by a dilligent search) need to be served notice of the name change and given the opportunity to contest it. Has his paternity been established by any court? Is his name on the birth certificate? Does he pay child support? Does your new husband wish to adopt your daughter?
