Changing my son's last name

My brother is incarcirated in Florida for drugs. His ex-wife is trying to change their son's last name from his father's last name to their family last name. He was served with court papers today and has 20 days to respond. Does he have any rights as he is a prisoner? He does not want his son's last name changed.

He has the same rights as any father. He does not have extra rights as a prisoner. As he is incarcerated, he will have to hire someone to appear on his behalf.
