Legal Question in Family Law in Florida

Child custoday

I have 2 children with a man I never married. When we split up, i got an injuction against him. Child support and visition was addressed with this. When the injuction ended in July 2007, so did everything else, from what I understand. There is no court order for him to pay child support, therefore he is not. Does he have legal right to visitation? Or can I tell him he is not allowed to see the children until we go to court or will this be against me?

Re: Child custoday

You need to file a petition for paternity to get your child support if the only order for child support you've ever had is the injunction. He may get visitation, but you could argue his violence as a means to deny him visitation or have his visitation supervised. It's almost always a bad idea to deny a father visitation and, in some circumstances, it can cost you custody. Speak to a lawyer before you deny him visitation.
