Re: child custody

She can establish a guardianship with her sister or, if her will provides, she can request the Probate Court to appoint her sister as guardian of her children upon her demise.

Talk to an attorney in your County or her County if different and he will provide a consult to advise what is involved.

Re: child custody

Not sure where in Florida you are, but a family law attorney can assist your aunt. She should ask the attorney about a pre-need guardian or temporary guardian in addition to preparing a valid will prior to her death. I am available to discuss with her in more detail if she wants to call my office or schedule a free consultation.

This is not an easy time for the family but at least your aunt has some time to get things in order before her passing.

My condolences to your whole family.
