Legal Question in Family Law in Florida

Child Custody Changes and back Child Support

My husband has had custody of his daughter since his divorce in '01. She is now 16 1/2 and wants to live with her mom. She ran away & her mom picked her up & took her out of the state without telling us. We filed a motion of contempt. In all honesty, if she doesn't want to stay with us, why make her? My problem is, we shouldn't have to pay CS to the mother when she never paid CS to us. My husband had just recently requested CS in '06 after she made false allegations against him regarding visitation. She now owes $7,000 in CS (CSE sent her contempt notices). Can we let her mom have custody and have her past due CS dropped in exchange for us not being required to pay CS for 1 1/2 yrs? - Thanks in advance for any help.

Yes, you can do exactly that, but the mom would have to agree.
