Child Custody Complications
I'm seperated from my husband of one year due to infidelity and domestic abuse. Recently, I was dismissed from active duty in the military and is now serving in the reserves in my home town. I moved myself to another state and my son to visit a family member to avoid abuse taking place in his presence, also until the issues have been resolved. I've received now an email from my husband stating that a judge has given him written authority to get my son, also for me to receive jail time if such actions have not been taken. Being that i haven't lived in this state for 6 months I've been told that i cannot file for a divorce as yet. Is there any advice or any actions that i can take to avoid my son getting placed into harms way or myself facing jail time for a decision I made to provide a more stable environment for my child?

You should be able to file for divorce in the county where you were married. Also, if your husband is using a judge, as part of the same case number, you are entitled to notice and an opportunity to be heard. You are going to need to get an attorney.
