child custody

My ex is the custodial parent, our court order has expired, he play's base and is currently with a team in new york. court order was made in fl, i live in NC. my daughter hhas told me that she's being punished to harshly by her step mom. she's in her step mothers care for the months that he's palying ball. is it legal for me to keep her and file for custody in north carolina since our court order has expired

The only state with jurisdiction now is Florida. I don't know how a Court order expires, unless you are referring to a temporary one. Best bet is to try to get back to Court. Since he was awarded custody, the standard to change custody will be "substantial change of circumstances." Have your lawyer where this was heard look at it.
