Legal Question in Family Law in Florida
Child custody after divorce
shortly after I divorced my ex (I'm talking about a month after) she was remarried and had a child (her new husband's). My ex received primary custody, but joint, of our daughter because I agreed to it to avoid long litigation and at the time thought she was a fit parent. However, after doing some public records searching into the background of her new husband I found out he was arrested for aggravated assault on his pregnant ex wife but was slapped on the wrist with Nolle prosequi. Consequently I am worried for the safety of my daughter. Can I do anything such as asking child services to monitor them or file for custody of my daughter because of this? It wouldn't be as bad if I lived closer to my daughter, but I am in a different part of Florida then she is. Any help would be greatly appreciated.

Re: Child custody after divorce
I doubt that child services will "monitor" them. They don't have the resources for that sort of thing. If an incident involving your child occurs, though, they will almost certainly investigate.
You could repoen your case and seek custody, but a charge of assault on a pregnant female that was nolle prossed (dropped) against him is very, very little evidence to go on.
