child custody

In the event BOTH parents were to be arrested for anything...one being a previously convicted felon, on probation, what happens to the minor children in the home?

As grandparents, is their anything we must or can do, to ensure that we can take the children, so that they do not become a ward of the state, if there is any danger in that happening at all? Sincere Thanks, S. Boyd

Generally, courts do look to the best interest of the child. If both parents agree for the child to be placed with the grandparents, the courts will usually abide, provided of course, that is what is in the child's best interest.

As grandparents, you would have an excellent chance to be named temporary guardians, depending on the nature and duration of the parents' problem. Likely, Dept. of Children & Families would investigate the situation and advise the court re the best interests of the children.
