Child Custody

I want to file for sole custody of my daughter. He father and I never married, and recently split. Since October 2005 he has gotten 2 DUI's, had 2 drug induced sizures, and been baker acted. His 2nd DUI was August 2007, after been arrested they took him to the hospital where he spent a few days in ICU, and then was Baker Acted... he says he's cleaning up his act this time, but i've heard it before. Is there a chance I could get legal and physical custody... and him get only SUPERVISED visits with her. She's only 10 months.

Absolutely, there is a chance but not a guarantee. You need to file for sole custody with the court and provide proof of your allegations to the judge. The judge will then make a determination if granting sole custody with only limited supervised visitation with the father was in the best interests of the child.
