Legal Question in Family Law in Florida
Child Custody Issue: I recently got divorced a year ago and we had been seperated for almost a year prior. We have a daughter together and she goes back and forth between her father and myself. Week on, Week off arrangement. When I seperated I moved to another city and he refused to let me move her school and had it put in the papers that I couldn't move her. So I have been traveling a good 40 miles round trip every other week to take her to school. On top of have to schedule my work hours around my daughters school hours. My ex husband does not work as he is on disability. I will be moving again because of a huge rent increase and will be moving to another city but it is still within the county that both of us reside in. Our divorce papers state I can't move her out of county, so I'm good there. Well I told my ex I was going to be moving and he still will not let me move her school because he says he can't drive that far to take her to school, yet I have been doing it for almost 2 years now and suggests that I just let him have our daughter all the time. Now I'm afraid that he may try to take me back to court and take my daughter away from me. What are my chances of losing my daughter? and Should I consider hiring a lawyer?

I would strongly urge you to speak with a Family Law attorney. It may be necessary to file a Petition to Modify the Final Judgment to eliminate the Joint Custody situation you now have. As an aside I never recommend Joint Custody because it never works.
