Child Custody Laws in Florida

I desperately need a divorce. My husband is emotionally and some times physically abusive-especially to me and my son. He moved me down to Fl. because his dad got him a job here. I want out of fl. and full custody. I also think that he does ''weird'' things with our step daughter. I catch things but it seems that it seems like I'm a minute to early or a minute too late. What do I have to do? Wait til I see her sexually abusing her? I assume I have to have proof, but I can't ever catch it. I WANT OUT! I do not want to live in FL...I want to live closer to my family for help in another state. I do not want him to have access to our son. He is an unhealthy individual. What are my rights?

It is not so much about grounds for a dissolution as it is for custody. Of course, as you know, it is the hard evidence that carries the day. As far as custody goes as of October 1st there are new provisions in the law that require a "parenting plan" be worked out.

You need to have a family attorney in your area consult with you about the strategies. You have no real authority over a step-daughter, but you could bring to the attention of a marriage counselor, who will be helping you.
