Legal Question in Family Law in Florida

child custody

I live in Florida and need to move out of state with my son. My son live with me the majority of the time and see his father once every two weeks. How do I find out what I need to do in order to move if we have shared custody.

NOTE: This communication is not intended as and should not be interpreted as legal advice. Rather, it is intended solely as a general discussion of legal principles. You should not rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorney's individualized advice for you. By reading the "Response" to your question or comment, you agree that the opinion expressed is not intended to, nor does it, create any attorney-client relationship, nor does it constitute legal advice to any person reviewing such information, nor will it be considered an attorney-client privileged communication. If you do not agree, then stop right here, and do not read any further.

If there is an order in place, you will have to go back to court and obtain permission to leave he State of Florida. The father and you have equal rights to the child and you cannot simply leave because it is more convenient or better for you. His rights have to be taken into consideration also. Only a court can make that determination if the parties cannot agree.
