Do a mother have to be found unfit for a father to win custody

It's not exactly like that. If contested, evidence is presented in court to determine who should have custody. Unless there are very young children who have been raised by a stay at home mom, there is no presumption in favor of the mother. The judge's decision is "what is in the best interest of the child."
