Legal Question in Family Law in Florida

I have been offered and accepted a position in Kansas and my husband will remain in Florida. We have not filed for divorce or separation. I want our three youngest children to move with me to Kansas and he wants them to stay in Florida with him. Our oldest child will remain with him because this is his last year of high school. My husband has threatened that if I take the children with me he will issue an amber alert and say that I kidnapped the kids. Am I doing anything illegal by taking them with me out of state?

It's not illegal for you to move your own kids out of state so long as no divorce or separation action is pending.
