Child Custody

I am a single father, and my son is currently in my care. His mother pasted away Feb. 14th 2008 and I am told that even thought I am the natural father and I am on his birth certificate, I still need to file for legal custody. I have been everywhere trying to do this. Even the court does not know the specific forms I need. I have found something on my own, Form FFLF 12.902(d) but it requires me to list the person I am filling against, which is no longer living. So... I do not know where to go from here, please help me.

As his father listed on the birth certificate you are entitled to custody automatically.
