Legal Question in Family Law in Florida
Child Custody and visitation
My ex husband and I share custody of our 14 year old son. For 9 years my son lived with his father. My son has now come to live with me, because emotional and physical abuse that he lived with at his fathers home. We did not file any papers through the court. My ex husband and son are still fighting at every visit that they have. My son now doesn't want to see his father and his father is upset and is taking me to court. Haven't recieved any papers yet. My son says he would run away if he has to live with his father. Of course his father blames me, which is not the case. I want my son to see his dad. I have not ever been in this situation and want to help my son. Please, do you have any advice of what the law is in Florida? I don't want to see my son suffer and now says he hates his father.

Re: Child Custody and visitation
As long as you are not involved in discouraging visitation or saying hateful things to your son about his father, then you are doing the best that you can do. You will just have to be sure that you inform the Court that you are encouraging visitation and ask if you son could speak for himself. Judge may consider this since your son is 14 years of age.
