Legal Question in Family Law in Florida

child custody/parenting agreement

My X boyfriend & I were together for 5 1/2 yrs & have 3 kids. He filed for custody/paternal rights back in 2004 (he was having an affair). We stayed together & had our 3rd child. He had another affair with a girl 20yr younger than him, got married & have since divorced (short marriage). A week after she left him he quickly moved a married girl with a kid in & now there is another female there too. We got a temp order 1 1/2 yrs ago in which we both are listed as primary residential parent when the children are in each others custody but nothing that states the word joint. Currently its 60/40 with me having majority but youngest is with me 95% of the time due to being a special needs child. Understanding is there cant be 2 primary residential parents in FL. Ive been trying to get this corrected & get a final order as this situation is not healthy for my kids & have professionals that confirm this. Where can I find or get a copy of the ''shared parenting agreement'' besides my atty? Supposedly it has been changed recently & need to see whats new. I dont agree with Joint with this man & need to have all legal rights. He is abusive & is trying to deny my kids from getting mental health help they need for ADHD.

Re: child custody/parenting agreement

You need to go back to court for a final order that takes into account any new circumstances. Florida law has changed and it is always joint now, unless you are dealing with an abusive situation -- which you could argue. You can get a copy of your parenting agreement from the court clerk.
