Child wants to live with non-custodial parent

My 16 yr. old daughter wants to live with her mother. Father took them years ago by lying and deceiving the court. He adopted her when she was an infant. The stepmother is very mean to her. Does she have a right to go to her mother's house?

She can go to visit. If she wants to stay you should seek court modification of the custody decree based on best interests of the child.

She is at a good age to express her wishes to the court. A Motion to Modify Custody needs to be filed with the court. At her age, the court will at least consider what she has to say and will probably want to speak with her if it comes down to an actual hearing.
