Legal Question in Family Law in Florida

I had a child with a man I was never married to. He did sign the birth certificate but was incarcerated two months later. Since then he has been in and out of jail. He has only seen my daughter once when she was 1, she is now 6. I have remarried and my husband who has been there since she was 2 and who she calls daddy, wants to legally adopt her. Does her biological dad, who is still in jail, have to agree and sign over his rights?
