Child using new married last name in school, keeping birth name

I have primary physical custody of my 7 year old daughter from a previous marriage. She requested to use my new married last name in school, to be the same as me. My ex-husband is demanding that she use his last name, her legal last name. I have not changed her name legally, it is only for school purposes, and she wants to keep it. It was her choice and we feel it is okay. Are there any laws stating that this is not permitted? Can he force her to use it, by law? My husband and I have joint legal custody, but I have physical custody.

It is assumed that your daughter use the last name she has used since her birth, unless the Final Judgment for Dissolution of Marriage states otherwise or there has been a Final Judgment for a name change for her.
