child support for a child approaching 18

My son will be turning 18 in June 07 and will be graduating from High School May of 07. He may be planning to attend a trade school for 2yrs. I pay for his medical,dental vision. His father is requesting to stop payments by June 15,07. because my son just got a parttime job as a bus boy making $55.00 aweek and states my son will not go to school. What are my legal rights in trying to request for child support for another yr, or so? We have been divorced for 21/2yrs. Would I need an attorney for a child support hearing schedule for May 7,07. Help and Feel lost!!

It depends on the terms of your child support agreement. If the father agreed to pay support after the child's majority if the child is attending school, then you are entitled to those payments unless a court finds that the child is self supporting. If the agreement is silent on support past the age of majority or just states "age of majority" without mentioning college or post-secondary school, then he is not obligated to continue payments (as long as the child has graduated from high school).
