Legal Question in Family Law in Florida
Child Support After 18 for Autistic Child
I currently pay support monthly, my court order states I will need to pay until my son reaches the age of majority. In Florida that age is set at 18 years old. My son will by 18 later this year. He is autistic. Can his mother takes me to court to continue the child support after he turns 18? And if so what can I expect? If I have to pay what is the max age at which the courts can make you pay support?

Re: Child Support After 18 for Autistic Child
If your child will be dependent for the remainder of his life, it's quite possible that you will have to pay lifetime support. There is no maximum age for child support termination where a child is disabled.
However, given that you already have a court order terminating support at the normal age, his mother would probably have to prove that it was unknown that he was autistic at the time the original child support order was entered in order to have the child support termination date changed.
If she tries to take you back to court, you should definitely hire a family lawyer.
