Legal Question in Family Law in Florida
child support
I have a child support case thru the Fl. Dept. of Revenue. The noncustodial parent is in NY. The order is for $25 a month and hasn't changed in the last 11 years. NY says that he doesn't have a job so the can't modify it. If I hire a lawyer and file a case in Florida, will Florida law prevail and they will actually set an amount according to minimum wage and make this deadbeat get a job or start losing rights???

If the case is filed in Florida, he'll have the right to dispute the jurisdiction. Child support cases (with a few rare exceptions such as in a post-divorce case) must occur where the person who is to pay the support lives.
