Legal Question in Family Law in Florida
I have a child support case in florida and the non-custodial parent has never made any payments until we end up going to court. In november he was ordered to pay a 500 dollar purge by december 9 but never made the payment. He was also told that a warrant would be issued if he didnt. On January 12th a non-payment of purge was submitted to the courts to issue a warrant by the department of revenue. A few days ago I went to child support to find out what was going on and they informed me that there would not be a warrant issued due to his finacial situation. I was told that at this time they cant do anything to him, I cant take him to court and they cant inforce paymant of any kind until he reports a change in his finacial situation. I dont understand this. He will never report a change because he has basically figure out how to avoid paying child support and not be punished for it. I know he works under the table, he does tree service but for him self so there is really no proof any where because he has nothing in his name. My question is how did he do this and how is this fair to me and my child?

YOu need to apply for assistance from Child Support Enforcement - Internal Revenue Dept.
Let them handle this and you will get medicaid for the child and state support which he will have to pay when and if he ever files a tax return and believe me, they will be watching.
