Legal Question in Family Law in Florida

Child Support

I just got a cour order for child support for my daughter, but I have a feeling her mother is going to try to take her out of the country so I won't see her anymore. There were never any visitation rights determined. What rights do I have if she does do that ??

Re: Child Support

1. Child support is independent of custody. A parent may be ordered to pay support even though he or she is not allowed to see the child.

2. The other parent cannot legally move to another country without your "permission." If she did that, it would be considered parental kidnapping. She must file an intent to relocate with the court and serve you with it. If you do not consent, she will have to make her case to the court that relocating to another country is in the best interest of the child.

Re: Child Support

Once she goes, you will be too late. Seek a restraining order now.
