Legal Question in Family Law in Florida

child support

I am the custodial parent of my child never have I lost my rights to him, however I was sentence to prison and during the time I was incarserated I gave my mother gaurdian ship in my behalf, not court ordered, just a hand written piece of paper. Since my release, I am again with my child and live with my mother. DCF has ordered me to pay child support on my child who I have custody over although they are aware that I was just released from prison, with no job or any way of transportation. I am now on medicaid and receive food stamps for me and my son. My mother use to have him on medicaid while I was in prison and she received cash assistance for his day care, she was acting in my behalf. Together we went to the child support enforcement office to explain our situation and they refused to stop the support. How do I fix this?

Re: child support

It all depends on the reason they gave you for pursuing this. Either way, if you do not have the ability to pay, they will have to work with you, even if you do end up owing support. Get a clear idea of why they are pursuing this and go from there.
