Legal Question in Family Law in Florida
Child Support, Divorce
I was married in June 2000. We have two children ages 4 and 2. Husband has kids, he is 27 and lives with his 2 retired parents who basically take care of the kids. We have had many problems in our marriage. One of which the husband was a ''crack head'' and that is why we are not together anymore. He decided that he would chose crack over keeping his family. He has temporary custody of our two children and his argument was because he lives in a nice neighborhood with his parents. Due to him being on crack, he was sent to a drug treatment facility and was kicked out yet the courts have given him temp custody. Why would the courts do such a thing? He has 1 prior conviction of possession of cocaine and 1 charge for aggravated battery on a pregnant female (me) but because I was scared of him I had the charges dropped and the state did not pick them up. I am now paying him child support, I feel that because he cannot be trusted with money and because most of the time his parents are taking care of the kids that his parents should be receiving the payments. I am in arrears $3,000; husband is now calling my job threating to pay or else. Is there anything I can do about that or can I get an injunction of this kind of case?

You certainly need legal representation. Without reviewing the court file no one can give you advice on how to proceed.

You will need to file a motion for a change of custody. I am available to consult with you on this case.
