Child Support

My husband is current on his child support and his ex-wife has continuously lost custody to the state. The child in is foster care. My husband is legally not allowed contact but is being asked to pay legal fee's for the change of payee due to the fact she is unable to regain custody. Can he refuse to pay? She is currently behind in her support to the foster care system.

Visitation and support are two separate things. You can be ordered to pay child support or moneys connected to child support even though you are not allowed to see the child. Furthermore, the fact that mom is behind on what SHE owes does not relieve the dad of HIS responsibilities. The only way to avoid responsibility for support is to give up one's parental rights.

Yes he still must pay child support. If he doesn't he could face sanctions/garnishments/loss of license.
