Legal Question in Family Law in Florida

child support issues

I married someone that is now being sought out by his ex wife for child support for one child. I want to know what my rights are concerning what I had before we were married and what have gotten since we got married? My paycheck, our checking account, my IRA, my home, my car etc etc. I have not been here before. He literally had nothing before marriage things are all mine. His work is handyman, self employed, I heard if he does not have the money I will have to pay as I married him. And she can garnish my wages, my bank account, car, home etc etc. Just because we are married now. No support order is in effect, we just heard she has applied to re open their divorce to ask for it. She ran off from Fl to Tenn with the child, not sure exactly. They got divorced no support was ordered at that time, she did not show up for divorce hearing, judge granted the divorce with she had the right to come back later for it. I just want to protect myself. I married him but not her and their pre-existing marriage and hassles. Can you advise me or help me out here?

NOTE: This communication is not intended as and should not be interpreted as legal advice. Rather, it is intended solely as a general discussion of legal principles. You should not rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorney's individualized advice for you. By reading the "Response" to your question or comment, you agree that the opinion expressed is not intended to, nor does it, create any attorney-client relationship, nor does it constitute legal advice to any person reviewing such information, nor will it be considered an attorney-client privileged communication. If you do not agree, then stop right here, and do not read any further.

You "heard" wrong. Your income is not considered in any legal proceeding for child support for your spouse's child from a former relationship. Only his income is taken into account.

You have no reason to worry. Your individual property and monies are safe. Your husband should seek the advice of a competent attorney to discuss his rights and obligations.
